The Substance of the Concept of Obligations and Human Rights (HAM) in Pancasila

Human rights or which can be abbreviated as human rights or in English is called human rights is the basic right that is owned by every human being from the beginning when he was born into the world. Human rights cannot be contested by anyone to carry out all the rights they have.


Human rights have several special characteristics, namely as follows:
  1. Essentially, which means human rights are the basic rights of all human beings who have been attached from birth.
  2. Universal, which means that human rights apply to all people regardless of status, religion, ethnicity, gender or other differences.
  3. It cannot be revoked, which means that human rights cannot be revoked or handed over to other parties or other groups.
  4. It cannot be divided, which means that everyone has the right to get all the rights except, whether civil or political, or economic, social and cultural rights.

Definition of Human Rights Obligations

  Human Obligations - (KAM) is something that must be done by every human being as a social and state creature. The term human rights is less well known than the term human rights, even celebrated and celebrated every year throughout the world. But this is not the case with human obligations that are often forgotten.

  Human Rights Enforcement - is every individual and every body in the community structure always upholds the value of respect for human rights and freedoms through progressive actions both nationally and internationally. But when humans have proclaimed themselves to be a people, nation or society in a country, individual human status will become the status of a wider citizen.

Definition of  human rights violations based on Law No. 39 of 1999 is any act of a person or group of people including State apparatus intentionally or unintentionally or negligence that violates the law, reduces, obstructs, limits and revokes the human rights of a person or group of people guaranteed by this law and does not get or is feared not will obtain a fair and correct legal settlement based on the applicable legal mechanism.

Human Rights Views in Pancasila Ideology

  Sejarah telah menjelaskan bahwa Pancasila adalah jiwa dari seluruh rakyat Indonesia, yang memberi kekuatan hidup kepada rakyat Indonesia serta membimbingnya dalam menjalani kehidupan lahir batin yang baik, di dalam masyarakat Indonesia yang adil dan makmur.

Human Rights in Ideal Value Sila-Sila Pancasila

  Ideal value is also called the basic value in relation to the five essence of Pancasila, namely: The Supreme Godhead, Fair and civilized Humanity, Indonesian Unity, Citizenship led by Wisdom Wisdom in deliberation / representation, Social justice for all Indonesian people.

These basic values are universal so that there are good ideals, goals, and values. This fundamental value is fixed and stuck on the survival of the State.

Relations between human rights and Pancasila can be summarized as follows:
  1. God Almighty: guarantees the right of freedom to embrace the desired religion, carry out worship and respect religious differences with one another.
  2. Fair and Civilized Humanity: places every citizen in the same position in the field of law and has the same obligations and rights to obtain legal guarantees and protection in the country.
  3. Indonesian Unity: mandates the creation of a unifying element among citizens with a spirit of willingness to sacrifice and place the interests of the nation and state above personal or group interests. This is in accordance with the principles of human rights.
  4. Population Led by Wisdom Consultative / Representative Policy: manifested in the life of government, state, and democratic society. Respecting the right of each individual to consensus deliberations carried out without pressure, coercion, or intervention that shackles the rights of community participation.
  5. Social Justice for All Indonesians: recognizing individual or group ownership rights and protecting their use by the state and giving as many opportunities as possible to the community.
Human Rights in the Value of Instrumental Sila-Sila Pancasila

  The instrumental value is the elaboration of the basic values in each principle in Pancasila. The instrumental value of Pancasila is more specific than the basic values. In other words, instrumental values are guidelines for the implementation of all Pancasila precepts. The realization of instrumental values generally takes the form of constitutional provisions. from the Constitution to regional regulations.

Human Rights in Pancasila Please-Sila Praxis Value

  The value of praxis is the realization of instrumental values of an experience in everyday life. The praxis value of Pancasila is always evolving and changes and improvements can be made in accordance with the times and the aspirations of the people. That is because Pancasila is an open ideology.

  Human rights in the praxis value of Pancasila can be realized if the basic and instrumental values of Pancasila itself can be applied in everyday life by all citizens. This can be realized if every citizen shows a positive attitude in his daily life. As for that positive attitude including the following:

  • Do not force to embrace a particular religion

  • Love each other
  • Feel free to others.
Indonesian Unity
  • Love the homeland
  • Rela sacrifice for national and state interests

  • Receive and execute every deliberative decision

  • Maintain a balance between rights and obligations
  • Respect for the rights of others
